Terms of Service

1. Service Description

Building Consent Check is an AI-powered document analysis tool that reviews building consent applications against Auckland Council requirements. The service:

• Analyses uploaded documents against Auckland residential building consent requirements
• Identifies common causes of Requests for Information (RFIs)
• Checks for consistency across documents
• Provides a report with identified issues and suggested fixes

2. What This Service Is NOT

3. AI Limitations

This service uses artificial intelligence to analyse documents. AI may:

• Fail to identify issues that exist in your documents
• Incorrectly flag issues that do not exist (false positives)
• Misinterpret information in your documents

You are responsible for verifying all findings and seeking professional advice where appropriate.

4. Active Development

Building Consent Check is a product under active development. This means:

• Features, accuracy, and analysis methods are continuously being improved
• Results may vary between analyses as the system is updated
• New checks may be added and existing checks may be modified
• The user interface and report format may change

By using this service, you acknowledge that you are using a product that is actively evolving and that analysis quality may vary as improvements are made.

5. No Refunds

Due to the immediate nature of the analysis:

• Payment is non-refundable once analysis begins
• Analysis begins automatically upon successful payment
• Ensure your documents are correct before proceeding

We may offer refunds at our discretion in cases of technical failure that prevents analysis from completing.

6. Document Handling

• Uploaded documents are processed for analysis only
• Documents are permanently deleted within 1 hour of analysis completion
• Documents are never used for AI training
• Reports are retained for 90 days to allow download access
• You can delete your online report immediately after downloading your PDF

7. Accuracy of Information You Provide

You confirm that:

• The email address provided is correct and belongs to you
• You have the right to upload and analyse the documents provided
• The documents relate to a genuine building consent application

8. Payment Terms

• Fees: Where applicable, fees are displayed before analysis begins and are inclusive of GST.
• Payment: Payment is processed securely by Stripe before analysis begins.
• One-time charge: Each payment is for a single analysis. There are no subscriptions.

9. Free Access

From time to time, we may offer free access to our services for testing or promotional purposes:

• Free access is provided at our sole discretion and may be withdrawn at any time
• Free reports are provided "as is" without warranty of accuracy or completeness
• Reports generated under free access should be independently verified before reliance
• By accepting free access, you agree we may contact you to request feedback (participation is voluntary)
• Free access tokens are single-use and non-transferable
• Free access tokens expire 30 days after being issued

10. Limitation of Liability

To the maximum extent permitted by New Zealand law:

• Building Consent Check is not liable for any consent application rejection
• Building Consent Check is not liable for any RFIs issued by council
• Building Consent Check is not liable for delays, costs, or losses arising from reliance on this report
• Our total liability is limited to the amount you paid for the service

11. Consumer Guarantees Act

Nothing in these terms limits your rights under the Consumer Guarantees Act 1993 where it applies.

12. Intellectual Property

• Your documents: You retain all rights to documents you upload. We do not claim any ownership.
• Our service: All aspects of Building Consent Check (software, design, content) are owned by us and protected by intellectual property laws.
• Analysis results: You may use analysis results for your building consent application.

13. Indemnification

You agree to indemnify and hold harmless Building Consent Check from any claims, damages, or expenses arising from your use of the Service or violation of these terms.

14. Privacy

Your use of the Service is subject to our Privacy Policy, which explains how we collect, use, and protect your information.

15. Modifications to Service

We reserve the right to modify, suspend, or discontinue the Service at any time without notice. We are not liable for any modification, suspension, or discontinuation.

16. Governing Law

These terms are governed by the laws of New Zealand. Any disputes will be subject to the exclusive jurisdiction of New Zealand courts.

17. Changes to Terms

We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance of the new terms.
